The Rural Emergency Hospital Designation

PROGRAM OVERVIEW 

Rural emergency hospitals (REHs) are a new provider type established by the Consolidated Appropriations Act of 2021 to address the growing concern about rural hospital closures. On Nov. 1, 2022, the Centers for Medicare and Medicaid Services released the CY 2023 Hospital Outpatient Prospective Payment System and Ambulatory Surgical Center Payment System final rule formally allowing certain hospitals to convert to an REH. This presentation describes the new regulations, the conversion process, the waiver of certain other regulations including the Stark law for REHs, additional Medicare payments, requirements for services offered, health and safety standards and more.

Seamus Taylor is an associate attorney in Nyemaster Goode’s corporate department, where he works with health care and insurance clients on regulatory, transactional and compliance issues.   
Willard Boyd III is a shareholder in Nyemaster Goode’s corporate department, where he advises health care and health insurance clients about regulatory matters, including privacy, certificate of need, insurance regulation, government contracts and compliance measures.
